Terms of Service

1. Agreement to Terms

By accessing or using HealChain ("the Service," "we," "us," or "our") at healchain.org or through our API, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

HealChain is operated as a technology service providing decentralized, blockchain-based data storage infrastructure including permanent document timestamping, credential verification, and record-keeping services.

2. Eligibility

You must be at least 18 years old to use HealChain Services (21+ for any gaming-related features). By using HealChain, you represent and warrant that you meet these age requirements and have the legal capacity to enter into these Terms.

3. Description of Services

HealChain provides blockchain-based timestamping, hashing, and permanent storage of digital records across multiple service verticals including:

• On-chain data storage — using Reed-Solomon erasure coding across multiple EVM-compatible blockchain networks
• Oracle infrastructure — for fulfilling storage and retrieval requests across 20+ chains
• API access — for developers and builders to store and retrieve data on-chain with a 40% revenue share program
• Vertical record vaults — Nurses, CDL, Creators, Insurance, Property, Metals, NFT, Estate, Business, Gaming
• Crypto payment processing — accepting ETH, Polygon, Arbitrum, Base, and other EVM-compatible tokens

We store only cryptographic hashes and structured metadata — your original files are never uploaded to our servers. The Services are for record-keeping, proof-of-existence, and verification purposes only.

4. Account and API Keys

• You are responsible for maintaining the security of your API keys and wallet credentials
• You must not share your API keys with unauthorized parties
• You are responsible for all activity that occurs under your API key
• If you believe your API key has been compromised, notify us immediately at security@healchain.org
• We reserve the right to suspend or terminate access for violation of these Terms

5. Acceptable Use

You agree not to use the Service to:

• Store illegal content, including content that violates intellectual property rights, child exploitation material, or content facilitating illegal activity
• Attempt to circumvent rate limits, access controls, or security measures
• Reverse engineer or attempt to extract proprietary components of the Service
• Store sensitive personal information such as government IDs or financial account numbers without appropriate encryption
• Use the Service in any manner that could damage, disable, or impair the Service or its infrastructure

You are solely responsible for the content you store on-chain. Because blockchain data is public and permanent, do not store private or sensitive information in an unencrypted form.

6. Payments, Credits and Refunds

• Payments for record storage are processed securely via Stripe or accepted cryptocurrency networks
• All payments are final and non-refundable once a record has been successfully stored on-chain
• Credits are non-refundable except at our sole discretion
• Fees are displayed before confirmation — you will always see the cost before committing
• If a payment is processed but storage fails due to a system error on our side, you are entitled to a retry or refund
• We reserve the right to modify pricing with reasonable notice

7. Gaming / Wager Record Vault — Specific Terms

The Gaming/Wager Record Vault is provided strictly as a record-keeping and verification tool. HealChain does not facilitate, accept, process, or settle any wagers. Users are solely responsible for compliance with all gambling, betting, and gaming laws in their jurisdiction.

• Must be 21 years of age or older to use gaming features
• Records stored do not create enforceable betting contracts or guarantee any payout
• HealChain bears no liability for disputes arising from any wager or betting agreement
• Users must acknowledge our Responsible Gaming Policy before storing any gaming records

8. Estate & Legal Documents — Specific Terms

Documents stored in the Estate vault receive blockchain timestamping providing proof of existence. This does not replace legal filing, court validation, notarization, or professional legal counsel. HealChain is not a law firm and does not provide legal advice.

• You represent that you have the legal right to store any document you submit
• Estate documents stored on-chain are public and permanently verifiable
• Blockchain timestamping may support but does not substitute for proper legal execution of wills, trusts, and powers of attorney

9. Blockchain Risks

You acknowledge and accept the following risks inherent to blockchain-based services:

• Blockchain transactions are irreversible once confirmed
• Smart contracts may contain bugs or vulnerabilities despite our best efforts
• Network congestion may delay or increase the cost of transactions
• The value of cryptocurrency used for gas fees may fluctuate
• Regulatory changes may affect the availability of the Service in certain jurisdictions
• We do not control public blockchain networks and cannot guarantee their continued operation

10. Intellectual Property

• HealChain's software, branding, and proprietary technology remain our intellectual property
• The ci-sha4096 cryptographic hash implementation is published under the MIT License
• You retain full ownership of any data you store through the Service
• By using the Service, you grant us a limited license to process your data as necessary to provide the Service

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. HEALCHAIN MAKES NO WARRANTIES REGARDING THE ACCURACY, LEGAL VALIDITY, ENFORCEABILITY, OR COMPLETENESS OF ANY STORED RECORDS.

WE DO NOT PROVIDE LEGAL, FINANCIAL, MEDICAL, OR GAMBLING ADVICE. We do not warrant that the Service will be uninterrupted, error-free, or that stored data will be retrievable in all circumstances.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEALCHAIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE FEES YOU PAID TO HEALCHAIN IN THE THREE MONTHS PRECEDING THE CLAIM.

13. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration rather than in court, except that either party may bring claims in small claims court.

• Arbitration conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
• Governing Law: State of Wyoming, without regard to conflict of law principles
• Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in a class action

14. Indemnification

You agree to indemnify and hold HealChain and its operators harmless from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms.

15. Modifications

We may update these Terms from time to time. We will notify users of material changes by updating the "Last Updated" date above. Continued use of the Services after changes constitutes acceptance.

16. Termination

We may suspend or terminate your access at any time for violation of these Terms. Records already stored on-chain cannot be deleted.
